These Terms of Service ("Terms") govern your use of the Harker application ("Harker" or "the Software") provided by Ourfires Ltd ("we," "us," or "our"). By downloading, installing, or using Harker, you agree to be bound by these Terms.

2. Description of Service

Harker is a voice-to-text transcription application that runs locally on your device. When activated by a keyboard shortcut, Harker listens to your voice input and converts it to text using AI transcription models, then pastes the transcribed text into your active text field.

3. License and Ownership

3.1 License Grant

Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to use Harker for your personal or business purposes.

3.2 Ownership

Harker and all related intellectual property rights remain the exclusive property of Ourfires Ltd. This license does not grant you any ownership rights in the Software.

3.3 Restrictions

You may not:

  • Reverse engineer, decompile, or disassemble the Software
  • Distribute, sell, lease, or sublicense the Software
  • Remove or modify any proprietary notices or labels
  • Use the Software to create competing products

4. Purchase and Payment

4.1 One-Time Purchase

Harker is sold as a one-time purchase. Once purchased, you own your copy of the current version and can use it indefinitely.

4.2 Payment Processing

Payments are processed securely through Stripe. We do not store or have access to your payment card information.

4.3 Major Version Updates

While minor updates and bug fixes are provided free of charge, we may require additional payment for major version releases with significant new features.

4.4 Alternative Purchase Options

Harker may be available through third-party platforms (such as Apple App Store or Setapp) which may offer trial periods or different purchase terms as per their respective policies.

5. Refund Policy

5.1 Refund Eligibility

We offer refunds within 14 days of purchase if you are not satisfied with Harker, subject to the following conditions:

  • You must contact our support team at support@getharker.com
  • You must provide a reasonable explanation for the refund request
  • Continued use of the Software after requesting a refund may void your refund eligibility

5.2 Platform-Specific Refunds

If you purchased Harker through a third-party platform (App Store, Setapp, etc.), refund requests must be made through that platform according to their refund policies.

5.3 Processing Time

Approved refunds will be processed within 5-10 business days to your original payment method.

6. System Requirements and Compatibility

6.1 Current Compatibility

  • macOS: Harker is currently available for Mac systems
  • Windows: Windows support is planned and will be available soon
  • Performance: Device performance significantly impacts Harker's speed and accuracy. Newer machines with more RAM will provide better performance

6.2 No Warranty of Compatibility

We do not guarantee that Harker will be compatible with all hardware configurations or operating system versions.

7. Transcription Accuracy and AI Models

7.1 AI-Powered Transcription

Harker uses various Whisper-based AI models for voice transcription. You can download and select different models based on your needs:

  • Larger models: More accurate but require more system resources and processing time
  • Smaller models: Faster processing but may be less accurate

7.2 No Accuracy Guarantee

While we strive for high transcription accuracy, we do not guarantee perfect transcription results. Accuracy depends on factors including:

  • Audio quality and clarity
  • Background noise
  • Speaker accent and pronunciation
  • Selected AI model
  • Device performance

7.3 Your Responsibility

You are responsible for reviewing and verifying all transcribed content before use.

8. Privacy and Data Processing

8.1 Local Processing

All voice processing occurs locally on your device. No voice recordings or transcribed text are transmitted to our servers or any third parties.

8.2 Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of Harker, to understand our practices.

9. User Responsibilities

9.1 Lawful Use

You are solely responsible for ensuring your use of Harker complies with all applicable laws and regulations in your jurisdiction.

9.2 Content Responsibility

Since all voice processing happens locally on your device, you are fully responsible for:

  • The content you choose to transcribe
  • Any actions taken based on transcribed content
  • Compliance with privacy laws when transcribing conversations involving others

9.3 Device Security

You are responsible for maintaining the security of your device and protecting your copy of Harker from unauthorized access.

10. Support and Updates

10.1 Customer Support

Technical support is available via email at support@getharker.com. We will make reasonable efforts to respond to support requests promptly.

10.2 Software Updates

We may provide updates, patches, and improvements to Harker. Minor updates and bug fixes are provided at no additional cost.

10.3 Update Notifications

If you provide your email address, we will notify you of available updates and important changes to these Terms.

11. Disclaimers and Limitations of Liability

11.1 "As Is" Basis

Harker is provided "as is" and "as available" without warranties of any kind, either express or implied.

11.2 Limitation of Liability

To the maximum extent permitted by law, Ourfires Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption.

11.3 Maximum Liability

Our total liability to you for any claims arising from your use of Harker shall not exceed the amount you paid for the Software.

12. Termination

12.1 Termination by You

You may stop using Harker at any time by uninstalling the Software from your device.

12.2 Termination by Us

We may terminate your license if you breach these Terms. Upon termination, you must cease using Harker and delete all copies from your devices.

12.3 Effect of Termination

Sections that by their nature should survive termination (including ownership, liability limitations, and dispute resolution) will continue to apply.

13. Changes to Terms

13.1 Modification Rights

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Posting updated Terms on our website
  • Sending email notifications to users who provided their email addresses
  • Including notifications in the Harker application when possible
